1. General applications

1.1. Unless otherwise agreed in writing, all sales made by BRAND LAIRAT Maryse, operating under the trade name «Paul Lairat Guitares & Basses», are governed without exception by the present Terms and Conditions of Sale.

1.2. The fact of placing an order implies full acceptance, without restriction or reservation, of these General Terms and Conditions of Sale.

1.3. The instruments are designed and manufactured by Paul Lairat, independent luthier. Sales, invoicing and customer service to the end-buyer are handled by BRAND LAIRAT Maryse.

2. Controls

2.1. Orders are not binding until confirmed in writing (purchase order or signed quotation) and, where applicable, after payment of a deposit. For instruments made to order, a deposit of 30 % of the total amount is required. The balance is payable when the instrument is completed and ready for shipment.

2.2. All orders are the responsibility of the buyer. Cancellation may be requested within 48 hours of confirmation. After this period, the deposit remains the property of the seller, unless otherwise agreed in writing.

2.3. A refund of the deposit will only be considered in the event of proven non-compliance, by the manufacturer, of the manufacturing deadlines announced at the time of the order, and after examination of the file.

3. Awards

3.1. Prices are freely defined by the seller. They do not include VAT (VAT not applicable - article 293 B of the French General Tax Code), excluding transport, packaging, insurance and any customs duties.

3.2. Transport costs, local taxes and customs duties applicable in the in the country of destination shall be borne by the purchaser, unless otherwise stated in writing.

4. Manufacturing and delivery times

4.1. The instruments presented for sale in the online store are available immediately, unless explicitly stated otherwise.

4.2. For custom-made and personalized instruments, manufacturing time is estimated between 7 and 8 months from order validation. This timeframe is indicative and may vary according to the complexity of the project.

4.3. Indicative delivery times are 4 to 10 working days within the European Union and the 9 to 15 working days for international deliveries outside the EU, from the date of shipment. These times relate exclusively to transport and do not include manufacturing time.

4.4. The seller cannot be held responsible for delays, losses, customs blockages or damage attributable to the carrier, customs blockages or damage attributable to the carrier or external events.

5. Transport

5.1. The purchaser shall bear all costs and risks inherent in the transportation from the point of loading to the place of destination.

5.2. In the event of breakage or damage on delivery, it is the recipient's responsibility to make precise and reasoned reservations on the delivery note to the carrier, and to inform the seller as soon as possible.

6. Receipt, returns and right of withdrawal

6.1. Any claim for non-conformity or apparent defect must be made in writing within a period of 48 hours after receiving the instrument.

6.2. Before any dismissal, the buyer must must inform the seller in writing in order to agree on the practical details of the return (address, transport, insurance, packaging). The purpose of this procedure is not to restrict the buyer's legal rights, but to ensure a secure and traceable return.

6.3. In accordance with the French Consumer Code, the buyer has the right to legal deadline of 14 days to exercise your right of withdrawal from receipt of the product, only for products standard eligible (not customized / not made to order).

6.4. The right of withdrawal does not apply custom-made and personalized instruments, in accordance with article L221-28 of the French Consumer Code (goods made to the consumer's specifications or clearly personalized).

6.5. Returns must be made postage paid, in suitable, protective packaging. If an instrument is returned damaged, poorly protected or damaged during the return journey, it may be refused or the necessary repairs may be invoiced.

6 bis. Refund

6 bis.1. In the event of a valid exercise of the right of withdrawal for an eligible product, the sums paid (excluding return costs) will be reimbursed within a maximum period of 14 days from the time of product recovery.

6 bis.2. The refund will be made using the same means of payment as that used at the time of the order, unless the purchaser expressly agrees to a different method, and at no additional cost.

6 bis.3. No reimbursement will be made for custom-made and personalized instruments (article L221-28 of the French Consumer Code), except in the case of a proven defect or recognized non-conformity.

6 bis.4. In the event of the return of a damaged or incomplete product, or one showing signs of use beyond normal handling, the seller reserves the right to apply a discount or to refuse reimbursement, after assessing the condition of the product.

7. Warranty

7.1. Electronic parts and fittings are guaranteed for one (1) year. The violin part (body, neck, structure) is guaranteed for three (3) years against manufacturing defects, under normal conditions of use.

7.2. The warranty covers only the repair or replacement of defective parts, after examination of the instrument by the seller.

7.3. Defects due to misuse, impact, dropping, unauthorized modification, improper storage or normal wear and tear are excluded from the warranty.

8. Clause de réserve de propriété

8.1. The seller retains ownership of the goods delivered until full payment has been received.

8.2. In the event of non-payment of an agreed due date, the seller may repossess the instrument after formal notice has remained without effect.

9. Jurisdiction and applicable law

9.1. These General Terms and Conditions of Sale are governed by French law.

9.2. In the event of a dispute, and failing an amicable solution, the Commercial Court of Carpentras shall have sole jurisdiction.
